Legislative Update - July 9, 2021

Gubernatorial Actions on Truly Agreed Legislation 

To date, Governor Parson has signed 48 out of 70 pieces of legislation: 29 regular bills, 18 appropriations bills, and 1 concurrent resolution.  This week, he signed legislation relating to taxation, public utilities, and military affairs, as well as legislation relating to the sale of intoxicating liquor, insurance, workers’ compensation, and COVID-19 exposure civil actions.  Today, he vetoed four bills.  The deadline for gubernatorial action for regular legislation will be Wednesday, July 14, 2021.  A list of all Truly Agreed bills, including outlines of the affected statutory sections, is set out below.   

First Extraordinary Session 

Both chambers of the General Assembly adjourned on Wednesday, June 30, 2021, ending the First Extra Session called by Governor Parson to extend the statutory expiration dates for provider taxes that fund the state’s federal reimbursement allowance (FRA) program.  On June 30th, the House third read and passed Senate Substitute #3 for Senate Bill 1, relating to MO HealthNet, which was signed by the presiding officers and presented to the governor on the same day. Governor Parson immediately signed the legislation; without an emergency clause, the bill will take effect ninety days after the adjournment of the extra session (September 28, 2021).    

Fiscal Year 2022 State Budget 

With the enactment of SB 1, the legislature avoided approximately $720 million in cuts forecast by the governor. On June 30, 2021, Governor Parson signed the appropriations bills making up the state budget for Fiscal Year 2022 (July 1, 2021, to June 30, 2022). The governor vetoed 49 line items in 12 budget bills ($114,687,879) and did not make any expenditures restrictions (“withholds”) at this time. The total FY22 budget is approximately $35.6 billion.  CCS SCS HCS HB 12 includes the state appropriations for the Judiciary (§§ 12.300 – 12.380) and the Office of State Public Defender (§ 12.400) for Fiscal Year 2022.

The only judiciary-related line item veto in House Bill 12 was $50,000 appropriated for staff for the Commission on Retirement, Removal, and Discipline of Judges. In the FY22 budget, the legislature did not include funding for judicial salary adjustments pursuant to the 2010 report of the Missouri Citizens’ Commission on Compensation for Elected Officials (adjustments as of July 2018, July 2019, July 2020, or July 2021). In addition, the budget did not include funding for implementation of the judiciary’s 21st Century Workforce compensation plan.
