Legislative Update: Governor acts on remaining 2023 legislation

Yesterday (Thursday, July 6, 2023), Governor Parson took action on the remaining legislation from the 2023 Regular Session, completing this part of the legislative process a week before the constitutional deadline of July 14, 2023.  Unless otherwise provided in the bill itself (with an emergency clause or a delayed effective date), the effective date of any approved legislation will be Tuesday, August 28, 2023.  Apart from line items vetoes, the governor vetoed a single piece of legislation – an omnibus public safety bill (SS SCS SBs 189, 36 & 37).  The legislature will automatically reconvene on Wednesday, September 13, 2023, to reconsider the vetoed bill or line item vetoes.  The effective date of legislation passed over a veto would be October 13, 2023 (unless the bill provides otherwise or veto session lasts more than a single day).  For full summaries of provisions of interest to the profession, please consult earlier prior Legislative Updates that highlighted the following areas:

On Friday, June 30, 2023, Governor Parson signed the bills making up the state’s Fiscal Year 2024 state operating budget, including House Bill 12, which includes state appropriations for the judiciary and the Office of State Public Defender, and House Bill 20, which includes capital improvement projects.

Among other items, appropriations for the judiciary included: 

  1. An 8.7% pay raise for state employees and a statewide mileage increase
  2. $8,630,106 for statewide court automation
  3. $5,000,000 for funding court improvement projects (security, bandwidth, and technology for remote proceedings for the courts)
  4. $4,547,684 for the expungement of records in accordance with Mo. Const., Art. XIV, § 2 (technology-related costs, temporary staff, and staff overtime)
  5. Approximately $985,000 for an additional circuit judge (and court reporter) in each of the following judicial circuits:  6th (Platte), 21st (St. Louis County), 31st (Greene), and 39th (Barry, Lawrence, and Stone)
  6. $160,074 for an additional associate circuit judge in the 11th Judicial Circuit (St. Charles)
  7. $320,148 for a reimbursable family court commissioner in each of the following judicial circuits:  16th (Jackson) and 21st (St. Louis County)
  8. $1,636,398 for the Supreme Court Library renovation and Judicial Learning Center
  9. $2,168,112 for the Supreme Court Building restoration
