Legislative Update: 2022 Veto Session and First Extraordinary Session

Veto Session

The General Assembly reconvened at noon on Wednesday, September 14, 2022, pursuant to the Art. III, Sec. 32 of the Constitution of Missouri.  The House of Representatives received the veto messages from the governor and adjourned until the following Wednesday, September 21, 2022, at which time it adjourned veto session sine die without votes on any motions to override the gubernatorial vetoes.  The Senate took similar action, but reconvened on Tuesday, September 20, 2022.  During the Tuesday session, Senator Mike Moon (R – Lawrence) sought to make an override motion on Senate Bill 724, but President Pro Tempore Dave Schatz (R – Franklin) ruled that the motion must be made by the sponsor senator, a ruling which the Senate sustained by a vote of 26 to 2.  The Senate adjourned until Wednesday, on which day it also adjourned sine die, ending the veto session of the 2nd Regular Session.

First Extraordinary Session

On Wednesday, September 14, 2022, both chambers also convened for the First Extraordinary Session called by Governor Parson on August 22, 2022, and set to begin at noon on September 6, 2022.  In the House, fifteen bills and one joint resolution were introduced.  In the Senate, twenty-three bills were introduced.  Several of the bills deal with topics not included in the governor’s call for the session. 

In the House, five bills were referred to committees, and the House Agriculture Policy Committee conducted a hearing on House Bill 3 (Pollitt), relating to agricultural economic opportunities, on Monday, September 19, 2022, and voted out a committee substitute by a unanimous vote of 14 to 0.  (Additional information about the committee hearing is included at the end of the update.)  On Wednesday, September 21, 2022, the House perfected the bill (with one floor amendment).  On the same day, the House third read and passed the bill by a vote of 83 to 28 (with 20 members voting present), but it failed to adopt the emergency clause, by which the bill would have taken effect upon the governor signing it into law.  If the bill is enacted without an emergency clause, it will take effect ninety days after the adjournment of the extraordinary session.  HB 3 has been reported to the Senate and awaits referral to committee.  The House has adjourned until Wednesday, September 28, 2022, for a technical session.

In the Senate, eighteen of the introduced bills were referred to the Senate Appropriations Committee and four bills were referred to the Senate Committee on Rules, Joint Rules, and Resolutions.  One bill remains on the first reading calendar.  On Monday, September 19, 2022, the Appropriations Committee heard the bills referred to it and (combining several bills together) voted out three bills – two relating to income taxes and one relating to agricultural tax relief.  The following day, the Senate laid over one of the bills – SCS SBs 1 & 6 (Crawford & Eslinger) – on the informal calendar and took up the remaining two bills for perfection.  Having perfected a Senate substitute for each bill, on September 21, 2022, the Senate third read and passed both bills.  SS SCS SBs 3 & 5 (Hough), relating to income taxes, was adopted by a vote of 24 to 4, with an emergency clause being adopted by a vote of 24 to 6.  SS SB 8 (Bean), relating to agricultural economic opportunities, was third read and adopted by a vote of 26 to 4, with an emergency clause being adopted by a vote of 24 to 6.  Both bills have been sent to the House for consideration, and SBs 3 & 5 have been referred to the House Budget Committee for consideration.  The Senate reconvened on Friday, September 23, 2022, for the referral of HB 3 to the Senate Appropriations Committee.  The Senate will reconvene on Monday, October 3, 2022, at 4:00 p.m. 
 

Missouri Bar-Initiated Legislative Proposals – 
Review and Comment on Proposals Submitted by Committees

The Board of Governors of The Missouri Bar has approved two 2022 Bar-initiated legislative proposals for carryover to the 2023 legislative session.  In addition, divisions and committees of The Missouri Bar have submitted six preliminary legislative proposals.  Pursuant to The Missouri Bar’s legislative procedures, those proposals must be published for review and comment by members of The Missouri Bar for a period of thirty days.  The draft proposals and comment links are available on the website of The Missouri Bar, and the review-and-comment period will conclude at 5:00 p.m. on Friday, October 21, 2022.  Following the comment period, the members of the originating division or committee will vote electronically on approval of the final proposal.  Provided a majority of those participating vote in favor of the final proposal, a request for approval will be submitted to the Board of Governors for consideration at its meeting on Friday, November 18, 2022.  Government Relations staff will publish a notice to members at least fourteen days prior to the Board meeting (Friday, November 4, 2022), listing those proposals which will be on the Board agenda for consideration.  If you have any questions, please contact Government Relations staff at 573-659-2280 or govrel@mobar.org for more information.
