Legislative Update for May 6, 2022

SEVEN DAYS REMAIN FOR CONSIDERATION OF BILLS IN 2022 REGULAR SESSION

Barring unexpected developments today, the General Assembly will have adopted a Fiscal Year 2023 state operating budget exceeding $45 billion.  Most of the day will be consumed by each chamber approving the conference committee reports for individual appropriations bill – first the House, and then the Senate – before the General Assembly’s constitutional deadline of 6:00 p.m.  Specific details on funding in House Bill 3012 and elsewhere for the judiciary and other justice system-related items will be included in next week’s Legislative Update. 

The time remaining for floor consideration of regular legislation will be dominated by floor debate and conference committees.  All bills remaining on the calendar after 6:00 p.m. on May 13, 2022, are automatically tabled.  The General Assembly has truly agreed to and finally passed eight bills and five joint or concurrent resolutions.  Excluding approximately a dozen appropriations bills, the General Assembly is likely to pass more than a hundred bills over the next seven days, with numerous statutory provisions included in multiple omnibus bills.  For a sampling of the legislation of potential interest to the profession filed during the present session, consult the latest issue of the Legislative Digest (online at Missouri Bar Publications or The Missouri Bar’s Legislative Engagement Center).  A complete breakdown of the Truly Agreed To and Finally Passed Legislation will be available to members of The Missouri in the August issue of the Legislative Digest (prior to the August 28, 2022, effective date of most new laws), and Legislative Updates throughout the summer will feature information about TAFP bills.

FLOOR DEBATE

On Monday, the House passed HCS SS SCS SBs 681 & 662 and returned the omnibus education bill to the Senate with twenty-two amendments.  The House also adopted HCS SS SCS SBs 775,751 & 640, relating to judicial proceedings, and returned it to the Senate with eleven amendments.  On Wednesday, the Senate truly agreed to and finally passed SB 886, relating to trusts.  This bill includes a Bar-initiated legislative proposal on decanting and other Bar-supported provisions relating to trusts.  During the House adoption process, an amendment relating to cemetery trust funds was added.  The Senate ultimately adopted the bill, as amended.  The Senate also truly agreed to and finally passed HCS SS #2 SCS SB 745, relating to public utilities, as amended by the House.  The Senate third read and passed three additional House bills, returning them to the House with Senate amendments.
